1. About Apex Online Tuitions
Apex Online Tuitions (“Apex”, “we”, “us” or “our”) provides an online technology platform for connecting learners, parents and independent educators. Apex facilitates discovery, profile display and communication, including direct WhatsApp coordination where available.
Apex is not the provider of tuition services, is not the employer of teachers, and does not act as an agent, broker or intermediary for the actual tuition relationship. Teachers provide tuition independently, and students/parents independently decide whether to engage them.
2. Direct Teacher–Student Relationship
Any tuition fee, class schedule, teaching method, syllabus, duration, location, cancellation arrangement and other tuition terms are agreed directly between the teacher and student/parent. Apex does not control or determine the tuition price and does not take a commission from tuition fees. Any separate Apex platform or membership fee, if introduced, is for use of the platform and is not a tuition fee.
3. WhatsApp and External Communication
Where a user chooses to contact another user through WhatsApp or another external communication service, that communication takes place outside Apex and is subject to the third party’s own terms and privacy practices. Users should exercise appropriate caution before sharing personal information or making arrangements.
4. Teacher Responsibilities
- Provide accurate and truthful profile information.
- Do not falsely claim qualifications, experience, certifications or results.
- Communicate respectfully and lawfully with students and parents.
- Do not use Apex to spam, harass, scam or mislead other users.
- Follow applicable laws and professional obligations.
5. Student/Parent Responsibilities
- Provide accurate registration and learning information.
- Evaluate teachers independently before entering into a tuition arrangement.
- Agree tuition fees and schedules directly with the selected teacher.
- Use the platform respectfully and only for legitimate educational purposes.
6. Verification
Creating an account or profile does not by itself mean that Apex has independently verified every qualification, certificate, identity detail or experience claim. Where Apex specifically identifies a profile or item as verified, the scope of that verification may be limited to the checks actually performed.
7. Safety and Minors
Parents or guardians should supervise interactions and tuition arrangements involving children and minors. Users should take reasonable precautions when sharing contact information, meeting in person or arranging home tuition. Apex does not guarantee the safety, conduct or suitability of any individual user.
8. Accounts and Security
Users are responsible for keeping their login credentials confidential and for activity conducted through their account. Users must promptly notify Apex if they believe an account has been accessed without authorization.
9. Prohibited Use
Users must not use Apex for unlawful activity, fraud, impersonation, harassment, threats, sexual exploitation, discrimination, malicious software, unauthorized data collection, spam, misleading advertising or any activity that harms other users or the platform.
10. No Guarantee
Apex does not guarantee that a user will find a suitable teacher or student, obtain tuition work, achieve a particular academic result, receive a particular income, or form a successful tuition arrangement. Platform availability may also be interrupted by maintenance, technical issues or circumstances outside our control.
11. Tuition Disputes
Disputes concerning tuition quality, fees, attendance, refunds, cancellations, teaching performance or other terms of the actual tuition arrangement are primarily matters between the teacher and student/parent. Apex may assist with platform-related concerns where reasonably possible but does not become a party to the tuition agreement.
12. Platform Fees and Payments
If Apex introduces a platform or membership fee, the applicable amount, billing period, payment method and refund terms will be displayed before payment. Platform fees are separate from any tuition fees agreed between users.
13. User Content
Users are responsible for information, photographs, descriptions and other content they submit. By submitting content, users confirm that they have the right to provide it and permit Apex to display and use it as reasonably necessary to operate the platform.
14. Intellectual Property
Apex’s branding, website design, software, text, graphics and other platform materials are owned by or licensed to Apex and may not be copied, reproduced or commercially exploited without permission, except where permitted by law.
15. Suspension or Termination
Apex may restrict, suspend or terminate access where it reasonably believes a user has violated these terms, provided misleading information, endangered others, misused the platform or created legal, security or operational risk.
16. Limitation of Responsibility
To the extent permitted by applicable law, Apex is not responsible for the independent acts, omissions, representations, qualifications, conduct, payments or agreements of teachers, students, parents or other users. Users use the platform and enter tuition arrangements at their own discretion.
17. Changes to These Terms
Apex may update these Terms & Conditions from time to time. The updated version will be published on this page with a revised date. Continued use of the platform after an update constitutes acceptance of the updated terms to the extent permitted by law.
18. Governing Law and Jurisdiction
These terms are intended to be governed by the laws applicable in India. Subject to applicable law and any mandatory dispute-resolution requirements, disputes relating to the Apex platform shall be subject to the jurisdiction of the appropriate courts.
19. Acceptance
By creating an Apex account, users confirm that they have read and accepted these Terms & Conditions and the Apex Privacy Policy. Registration is not permitted without the required consent.
